In this issue: Prosecutions of insider trading at Uchumi, Court of Appeal goes on holidays, and water rate adjustments for Lake Victoria North region.
Capital Markets Authority The Attorney General has appointed a lawyer to head prosecutions against suspects charged with offences against the Capital Markets Authority Act. Lawyer Kioko Kilukumi has been appointed to be a prosecutor for such cases and in particular for two cases currently in court. Kilukimi will now replace State Counsel Mungai Warui as the lead prosecutor in the case in which former Kenya Commercial Bank managing director, Terrence (Terry) Davidson, is charged with four counts of insider trading at retail chain Uchumi. He allegedly instructed Suntra Investment Bank to buy for him 664,899 Uchumi shares worth about KES9.5m on 2 December 2005 and instructing Suntra to sell 300,000 shares worth about KES5m on 9 May 2006, just days before the retail chain collapsed under substantial debts owed to banks and suppliers. Bernard Mwangi Kibaru, a former Uchumi general manager, is also accused of instructing Drummond Investment Bank to dispose 111,400 of his shares on 26 April 2006, through insider knowledge. Court of Appeal Vacation The Christmas vacation for the Court of Appeal will commence on 21 December 2008 and will terminate on 13 January 2009. During the vacation, the Registry of the Court will be open to the public from 9am to noon on all weekdays except public holidays. A judge will be in attendance for the disposal of any urgent business. The High Court announced its vacation dates last week Kenya Gazette Highlights for 28 November 2008. Water Rate Adjustment for Lake Victoria North Water Region Water rates for the entire Western Province and parts of Rift Valley Province have been revised upwards for different categories. According to Diru Magomere, the Chief Executive Officer of Lake Victoria North Water Services Board (LVNWSB), the rising tariffs have been necessitated by the rising cost of chemicals, electricity, fuels and lubricants and maintenance materials. Domestic consumers will be paying KES1,000 per month for usage of less than 50 cubic metres. Hotels class A and B using less than 150 cubic meters will now pay KES10,000 while hotels class C and D using more than 150 cubic meters will pay KES15, 000. Light industries using less than 200 cubic meters will be paying KES10,000 while medium industries using 200 to 300 cubic meters will pay KES15,000. Heavy industries using more than 300 cubic meters will be paying KES20,000. Comments (0)
