Appointment of Micah Cheserem as Chairman of the Capital Markets Authority The appointment of former Central Bank of Kenya (CBK) Governor, Micah Cheserem as the Chairman of the Capital Markets Authority (CMA) by President Mwai Kibaki has been officially gazetted. Mr. Cheserem will be the Chairman of the CMA for a period of three years with effect from 23 February 2009. The Restrictive Trade Practices, Monopolies and Price Control Act The Finance Minister and Deputy Prime Minister Uhuru Kenyatta has agreed to the purchase of Wab Hotels Limited by James Kaniiya Gachiri. Located in Nairobi, Wab Hotel is situated in Buru Buru Shopping Centre. It is classified as a category D hotel and is mostly used for conferences by budget conscious groups. Directions on the Filing of Suits, Applications and References in Courts Chief Justice Evan Gicheru has made practice directions for the filing of cases in the Country’s courts. Under Kenyan law, a suit is generally to be in the pecuniary jurisdiction of the court, the place where the issue in dispute or property is situated, the place where the cause of action arose and where the defendant or any of the parties reside of work or gain. The chief justice, however has powers conferred to him by the by the constitution and the Civil Procedure Act to make practice directions. The place of suing is now to be determined in accordance with the provisions of sections 11 to 18 of the Civil Procedure Act and not according to the preference or convenience of the suing party. The courts and the filing registries must strictly observe the provisions as to the place of suing by allowing only those that comply with the law and rejecting those that do not. Where suits have already been filled in the wrong court, the court should exercise its authority under the Civil Procedure Rules to return the plaint to be presented to the court in which the suit should have been instituted, without prejudice to any other powers that it may possess under the law to strike out the pleadings as an abuse of the process of the court. The filing of appeals, bail applications and references from subordinate courts should be made at the High Court with corresponding supervisory jurisdiction according to the established judicial administrative districts. All judicial review proceedings and constitutional applications and references shall be serially registered in a special register(s) and be heard by the High Court for the respective area on a priority basis and without delay. The schedule of the relevant courts in each province are set out in the Gazette for 27 February 2009 as gazette notice no. 1756. Kenya Civil Aviation Authority Decides on Air Service License Applications The Kenya Civil Aviation Authority has made its decisions on the application for licenses made in January 2009 Aviation License Applications. Of the 22 airlines that had applied for licenses, only one, Diamond Crest Ltd, did not get the licenses. The decision for Diamond Crest Ltd was deferred, but no time was given for the deferment. NEMA: Report on Proposed Common User Facility for Receipt of Liquefied Petroleum Gas (LPG) at Port Reitz, Mombasa The National Environment Management Authority (NEMA) is inviting comments for the proposed implementation of a common user facility for receipt of liquefied petroleum gas (LPG) at Port Reitz, Mombasa. The proposed project entails construction of a conventional buoy mooring (CBM) system, a sub sea LPG pipeline 4.2 Km in length, and a common user manifold (CUM). The full report of the proposed project is available for inspection at NEMA offices in Mombasa, the Permanent Secretaries office, Ministry of Environment and Natural Resources in Nairobi and the Provincial Director of Environment, Coast Province, as well as the District Environment Office, Kilindini District. Members of the public have 30 days top make oral or written comments to assist NEMA approve the process. NEMA: Report for Proposed Kwale Sugar Company, Ramisi, Msambweni NEMA has received an environmental report for the proposed Kwale Sugar Company in Ramisi, Msambweni District in Coast Province. The proposed project will rehabilitate sugar plantation, factory, install a cogeneration power plant and a distillery. The factory will be constructed at the old Ramisi Factory site, Kigwede/Shirazi location, Msambweni District in Kwale Region of Coast Province. The full report of the proposed project is available for inspection at NEMA offices in Mombasa, the Permanent Secretaries office, Ministry of Environment and Natural Resources in Nairobi and the Provincial Director of Environment, Coast Province as well as the District Environment Office, Kwale District.
