Local Income Tax Committees for Mombasa and Nyeri Appointed
Minister for Finance Uhuru Kenyatta has appointed two local income tax committees for Mombasa and Nyeri. Local Income Tax Committees are quasi-judicial tribunals set up by the Minister of Finance to hear and determine tax disputes between the Kenya Revenue Authority (KRA) and tax payers. Although their decisions are binding, they are not final and an aggrieved party can appeal to the High Court.
The Mombasa Committee will be chaired by Geoffrey Nafukho Omulayi. The Committee consists of eight additional members. The Nyeri Committee is chaired by Wilfred Nderitu Gichuki and consists of eight additional members.
Labour Relations Act
Minister for Labour John Munyes has made orders to companies who are members of the Union of Kenya Hotel Keepers and Caterers Association to deduct from the wages of each unionisable employee who is not a member of the Kenya Union of Domestic, Hotels, Educational Institutions, Hospitals and Allied Workers a sum equal to 2% of the employee’s wages or KES150 per month, whichever is the lower.
The deductions commence within thirty days of receiving the order. The companies should remit the sums deducted by crossed cheque payable to the union into the union’s account number 1822215 at the Barclays Bank of Kenya Ltd, Queensway Branch, Mama Ngina Street, Nairobi.
The minister has also ordered the Italian Space Agency (ASI) San Marco Project to deduct every month 2.5% of the basic salary of every employee covered by the terms and condition of parties Collective Bargaining Agreement in force but not members of the Kenya Building, Construction, Timber, Furniture and Allied Industries Employees Union in respect of wages earned from March 2009.
ASI should pay, within ten days of the deduction the total sums deducted under the schedule by a crossed cheque made payable to the Kenya Building, Construction, Timber, Furniture and Allied Industries Employees Union’s account in account number 230646481 at Kenya Commercial Bank Ltd, Moi Avenue Branch, Nairobi, and then make returns to the Registrar of Trade Unions within one month of making all the payments.
A list of the employees eligible to pay the agency fees is published in a schedule in the Kenya Gazette of 20 March 2009.
Court of Appeal Easter Vacation
The Easter Vacation for the court of appeal will commence on 2 April 2009 and terminate on 21 April 2009. During the vacation, the registry of the court will be open to the public from 9.00am to 12.00 noon on all weekdays except public holidays. A judge will be in attendance for the disposal of any urgent business.
The Kenya Communications Act Application for Licenses
The Communications Commission of Kenya (CCK) has received six license applications for intra country postal and courier service providers: Premium Travelers Ltd, Wasoow Parcel Services, N.O.K.K. Co-operative Savings and Credit Society, North Rift Luxury Shuttle, Lakesider Courier Services and Riler Services Ltd have all applied for the grant of licenses to enable them provide and operate postal/courier services.
Statutory Manager for Standard Assurance Limited Appointed
Standard Assurance Kenya Ltd (under statutory management) has got a new statutory manger. The Commissioner of Insurance and Chief Executive Officer have appointed HLB Ashvir Consulting Ltd to act as statutory managers of Standard Assurance with effect from 11 March 2009. The statutory manager has declared a moratorium on the payments of Standard Assurance to its policy holders and all other creditors for a period of 12 months with effect from 27 March 2009.
National Environmental Management Authority (NEMA)
NEMA has received an environmental impact assessment for a proposed dumping site at Ruai Area in Nairobi. The proposed project will provide waste collection services via private waste and garbage collectors and dispose of the wastes generated and collected.
The project will be located in Ruai next to the sewerage treatment works. The full report of the proposed project is available for inspection during working hours at the director general for NEMA’s office, the Permanent Secretary, Ministry of Environment and Mineral Resources offices, and the District Environment Office, Nairobi East District. Members of the public have 30 days to submit comments about the project.
The Liquor Licensing Act
The Chairman of the Makueni Liquor Licensing Court has given notice of a statutory meeting of Makueni Liquor Licensing Court that will be held in the District Commissioners boardroom on Monday, 11 May 2009. Applications to be considered at this meeting for new licenses, renewals, transfers, removals or conversion of licenses should be submitted with KES10 adhesive revenue stamps affixed on the submission forms. Late applications will be accepted if received on or before 9 April 2009 on payment of KES1,000 as late application fees.
Applications for new, transfer, removal or conversion of licenses must appear in person before the court or be represented by an advocate. Attendance in court by renewal applications is optional unless there are objections in which case attendance will be desirable. Applicants for renewals must attach copies of their current licenses and send their applications by registered post or deliver them by hand.
The Chairman of the Kiambu District Liquor Licensing Court has also given notice of the next statutory meeting in Kiambu, which will be held on Monday, 11 May, 2009. Applications to be considered at this meeting for new, renewal, transfer, removal or conversion of licences should be submitted I the prescribed forms with KES10 adhesive revenue stamp affixed to the submission forms. Late applications will only be accepted if received on or before 10 April 2009 on payment of KES1,000 being late application fee.
